Terms of Service

These Terms of Service ("Terms") govern your access to and use of The CATM Shop website, online store, content, products, and related services (collectively, the "Services"). By visiting the Store, placing an order, or otherwise using the Services, you agree to these Terms and our Privacy Policy and Return and Refund Policy.

If you do not agree to these Terms, do not use the Services or place an order. You must be at least the age of majority in your place of residence, or have permission from a parent or legal guardian, to make a purchase.

Store Platform and Fulfillment

The Store is hosted by Shopify. Products may be produced, customized, and fulfilled by Printify and independent print providers. Payment processors, carriers, and other third parties may also participate in completing an order. Their services may be subject to separate terms and policies.

Orders

An order is an offer to purchase. We may accept, reject, limit, or cancel an order for reasons including suspected fraud, pricing or listing errors, product unavailability, fulfillment limitations, sanctions or legal restrictions, or misuse of the Services. A payment authorization or order confirmation does not require us to accept or fulfill an order.

You are responsible for providing complete and accurate account, billing, customization, and shipping information. You are also responsible for reviewing product descriptions, selected variants, personalization details, size information, quantity, and delivery address before checkout.

Products and Made-to-Order Variations

Many products are made to order. Colors and appearance may vary because of screen settings, garment batches, materials, print placement, embroidery, manufacturing tolerances, and production methods. Images and mockups are illustrative and do not guarantee an exact color or placement match.

We may change or discontinue products, designs, prices, descriptions, and availability without notice. Our Return and Refund Policy governs damaged, defective, incorrect, personalized, and made-to-order products.

No Government or Military Affiliation

Unless expressly stated otherwise, the Store and its products are not sponsored, endorsed, approved by, or affiliated with the United States Department of Defense, the Department of the Air Force, any military unit, or any other government agency. Product designs and descriptions are not official uniforms, equipment, safety gear, technical guidance, or government-issued materials.

Personal and Non-Safety Use

Apparel and accessories sold through the Store are intended for ordinary personal use. They are not personal protective equipment and are not designed or certified for combat, weapons handling, hazardous work, fire resistance, medical use, emergency response, or any safety-critical purpose. You assume responsibility for determining whether a product is suitable and lawful for your intended use.

Acceptable Use

You must not use the Services to:

• Violate any law, regulation, court order, or third-party right.
• Commit fraud, impersonate another person, or provide false information.
• Interfere with the Store, introduce malicious code, or bypass security.
• Scrape, copy, resell, or commercially exploit Store content without permission.
• Upload or request unlawful, infringing, abusive, or deceptive customization content.
• Use products or content in a way that suggests unauthorized endorsement or affiliation.

We may suspend or terminate access, cancel orders, or cooperate with authorities when we reasonably believe the Services are being misused.

Intellectual Property

The Store's original text, graphics, logos, designs, photographs, arrangement, and software are owned by or licensed to us and are protected by applicable intellectual-property laws. No rights are granted except the limited right to use the Store for personal shopping.

If you submit customization content, you represent that you own or have permission to use it. You grant us and our fulfillment providers a limited license to reproduce and process that content only as reasonably necessary to produce, fulfill, support, and document your order.

Third-Party Services and Links

We are not responsible for third-party websites, apps, payment processors, carriers, Shopify, Printify, print providers, or other independent services. Links or integrations do not constitute an endorsement. Your use of a third-party service is at your own risk and subject to that party's terms.

Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES AND PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, OR QUIET ENJOYMENT.

WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR FREE FROM HARMFUL COMPONENTS, OR THAT PRODUCTS WILL MEET SUBJECTIVE EXPECTATIONS. SOME JURISDICTIONS DO NOT ALLOW CERTAIN WARRANTY DISCLAIMERS, SO THESE DISCLAIMERS APPLY ONLY TO THE EXTENT PERMITTED BY LAW.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE CATM SHOP AND ITS OWNERS, OPERATORS, PERSONNEL, AFFILIATES, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES; LOST PROFITS, REVENUE, DATA, GOODWILL, OR OPPORTUNITIES; BUSINESS INTERRUPTION; OR THE COST OF SUBSTITUTE GOODS OR SERVICES, ARISING FROM OR RELATED TO THE SERVICES, PRODUCTS, OR THESE TERMS, REGARDLESS OF THE THEORY OF LIABILITY AND EVEN IF ADVISED THAT SUCH DAMAGES WERE POSSIBLE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO A PRODUCT, ORDER, OR THE SERVICES WILL NOT EXCEED THE AMOUNT YOU PAID US FOR THE PRODUCT OR ORDER GIVING RISE TO THE CLAIM.

These limitations do not exclude liability that cannot legally be excluded or limited, including liability for fraud, willful misconduct, or certain personal injuries where applicable law prohibits exclusion.

Indemnification

To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless The CATM Shop and its owners, operators, affiliates, personnel, licensors, and service providers from claims, losses, liabilities, damages, judgments, and reasonable costs arising from your unlawful misuse of the Services, violation of these Terms, infringement of another person's rights, customization content, or unauthorized representations about the Store or its products.

Force Majeure

We are not responsible for delay or failure caused by events outside our reasonable control, including carrier disruptions, supplier or print-provider failures, labor disputes, severe weather, natural disasters, war, terrorism, civil unrest, epidemics, utility or internet failures, cyberattacks, government actions, or shortages of materials.

Consumer Rights

Nothing in these Terms limits a right or remedy that applicable consumer law does not allow you to waive. If a disclaimer, limitation, or other provision conflicts with such law, it applies only to the maximum lawful extent.

Changes and Termination

We may update the Services and these Terms from time to time. Changes become effective when posted, except where notice or consent is legally required. We may suspend or discontinue any part of the Services, subject to obligations for accepted orders and applicable law.

Severability and No Waiver

If any provision is found unenforceable, it will be enforced to the maximum lawful extent and the remaining provisions will remain effective. A failure to enforce a provision is not a waiver of that provision or any other right.

Entire Agreement

These Terms, together with the Privacy Policy, Return and Refund Policy, and other policies displayed at checkout, form the entire agreement concerning your use of the Services and purchases from the Store.
